This Privacy Statement explains how Pressflex LLC ("Pressflex", "Racery", "We" or "Us") uses your information and applies to all users of the Racery Service available at our website, www.racery.com (the "Site") and through our Racery mobile applications (collectively, the "Service"). This Privacy Statement is incorporated in our Terms of Use. This page informs you of our policies regarding the collection, use, and disclosure of personal information when you use our Service and the choices you have associated with that data. We will ensure that all personal information disclosed by you and that is held by us will be: (i) processed lawfully, fairly, and in a transparent manner; (ii) collected for specified, explicit, and legitimate business purposes and not further processed in a manner that is incompatible with those legitimate business purposes; (iii) adequate, relevant and limited to what is necessary; (iv) kept in a form which permits identification of data subjects for no longer than is necessary; and (v) processed in a manner that ensures appropriate security of the personal information, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
We may modify this Privacy Statement from time to time in our sole discretion by posting such modifications to our Privacy Statement available through the Service. We will endeavor to notify you in the event of any material changes to this Privacy Statement, which may include notification by email reminders, notices on the Service or other reasonable means. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this statement. Unless otherwise defined in this Privacy Statement, terms used in this Privacy Statement have the same meanings as in our Terms of Use, accessible from www.racery.com. By using the Service, you agree to the terms of this Privacy Statement. If you do not agree with the practices described in this Privacy Statement, you are not permitted and should not use the Service. Use of the Service after we have posted modifications to this Privacy Statement shall constitute your agreement to the modified Privacy Statement. The date of the current version of this Privacy Statement is set forth below.
Information Collection and Use
We collect several different types of information for various purposes to provide and improve our Service to you.
Cookie Consent and Management
When you first visit our Service, you will see a cookie consent banner informing you about our use of cookies and asking for your preference. You can manage your cookie preferences at any time.

Categories of Personal Information We Collect
We collect the following categories of personal information:
Identifiers: Name, email address, mailing address, unique online identifiers, IP address, device identifiers
Personal Information (Cal. Civ. Code § 1798.80): Name, mailing address, email address
Protected Classifications: Age range (to verify users are 13+), gender (if voluntarily provided in Bio)
Commercial Information: Records of races joined, purchases, payment information (processed by third-party payment processors)
Internet/Network Activity: Browsing history on our Service, information about your interaction with our Service, advertisements, or emails
Geolocation Data: General location information derived from IP address; precise location if you voluntarily provide it in race updates or Bio
Professional/Employment Information: If voluntarily provided in your Bio
Inferences: Preferences and interests derived from your race participation and Service usage
AI Chat Interactions: Questions you submit to our AI chat assistant, AI-generated responses, session identifiers, feedback ratings, and on race pages, race activity data used to personalize responses (see "AI-Powered Features" section below)
Sources of Personal Information:
- Directly from you when you register, create content, or communicate with us
- Automatically when you use our Service (cookies, analytics)
- From Social Networks if you link your account
- From third parties such as data analytics providers
Business Purposes for Using Personal Information:
- Providing, maintaining, and improving the Service
- Processing transactions and delivering race services
- Communicating with you about races, updates, and promotions
- Analyzing Service usage and user preferences
- Delivering targeted advertising (with your consent where required)
- Detecting and preventing fraud and security threats
- Complying with legal obligations
Personal Data: While registering for or using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include but is not limited to: Name, preferred Nickname: You provide us with a first and last name when you join a Race or Team. You may provide other Personal Data when you create or update your Bio through the Service, interact with the Service by posting Race or Team updates, respond to our emails with race updates and comments, submit answers to our surveys, post comments or chat through our Service, contact customer support, or connect or link to the Service via your Social Networks.
Email Address: You provide us with your email address when you join a Race or a Team.
Mailing Address: You may also provide us with a mailing address when you register for some fundraiser or medal races.
Bio/Race Updates: You may voluntarily provide us with additional Personal Data in connection with your interaction with the Service including by completing or updating your Bio or posting Race updates. You may upload photographs, provide us with your location, describe your physical activities or efforts or other Personal Data.
Usage Data: We may also collect information on how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, unique device identifiers, mobile network information and information about interaction with the Service such as the pages of our Service that you visit, the time and date of your visit, the time spent on the Service and other diagnostic data.
Tracking & Cookies
We use cookies and similar tracking technologies on our Service. Cookies are small data files stored on your device that help us provide and improve our Service. This section describes the types of cookies we use and the third-party services that may set cookies or collect data when you use our Service.
Essential Cookies (Required):
These cookies are necessary for the Service to function and cannot be disabled.
csrftoken: Protects against cross-site request forgery attacks. Set automatically by our web framework.sessionid: Keeps you logged in to your Racery account so you don't need to re-enter your credentials each visit. Duration: 2 weeks.cc_cookie: Records your cookie consent preference so you are not asked again on future visits.
Analytics Cookies (Optional — require your consent):
- Google Analytics (UA-48311803-2): Helps us understand how visitors use our Service, including demographics and interest data. Sets cookies to distinguish unique users and track sessions. Duration: up to 2 years.
- Google Tag Manager (GTM-K2LTM8): Manages the loading of our analytics and advertising scripts. Does not set cookies directly but enables other services listed here.

Advertising/Marketing Cookies (Optional — require your consent):
We use advertising cookies and tracking pixels to measure the effectiveness of our marketing and to show you relevant Racery advertisements when you visit other websites. The following third-party services may set cookies or collect data when you use our Service:
- Google Ads / DoubleClick: Used for remarketing — shows you Racery ads on websites in Google's advertising network based on your visit to our Service. Duration: up to 2 years. Opt out at: https://www.google.com/settings/ads
- Facebook / Meta Pixel (ID: 1761563300795001): Tracks page views on our Service to measure ad effectiveness and enable retargeting on Facebook and Instagram. Duration: up to 2 years. Opt out via Facebook ad preferences: https://www.facebook.com/adpreferences
- The Trade Desk: Programmatic advertising platform used to measure ad campaign performance. Opt out at: https://www.adsrvr.org/opt-out.html
- Programmatic ad partners: Our advertising partners may share data with exchanges and platforms including Xandr (adnxs.com), Rubicon Project, Adobe Audience Manager (demdex.net), Tapad, and others to deliver and measure advertisements.
visited_pagescookie: A first-party cookie that records which types of pages you visit on our Service (e.g., informational pages vs. race creation pages) to help us understand user interests for advertising purposes. Duration: 1 year.

AI-Powered Features
The Service may include an AI-powered chat assistant on certain pages. This feature is not enabled on all Races and may not be present during your use of the Service. When the AI chat feature is available and you choose to use it, the following applies:
Data We Collect Through AI Features:
- Chat messages: The questions you ask and the AI-generated responses, stored as part of your chat session
- Session metadata: A randomly generated session identifier, the page URL where you initiated the chat, the chat persona type (e.g., support, coaching), and timestamps
- Feedback: If you provide feedback on a response (such as a thumbs up or thumbs down rating), we record that feedback along with the associated message
- Race activity data (race pages only): When you use the AI assistant on a race page while logged in, we may use your race activity data — including distance logged, current position, days since last activity, and leaderboard standing — to provide personalized, motivational responses
How We Process This Data:
Your chat messages and relevant context (including race activity data where applicable) are transmitted to our AI service provider, Anthropic, PBC, which processes this data to generate responses. Anthropic processes this data pursuant to its commercial terms and does not use your data to train its AI models. For more information, see Anthropic's privacy policy at www.anthropic.com/privacy.
Automated Personalization:
On race pages, our AI assistant may use your race activity data to classify your current participation status (such as whether you are near a milestone, recently active, or approaching the finish line) in order to provide relevant motivational messages and suggestions. This classification is used solely to personalize the chat experience and does not produce legal effects or similarly significant effects on you. You can access the same information and support without personalization by contacting team@racery.com or browsing our Knowledge Base.
Retention:
Chat session data (messages, responses, metadata, and feedback) is retained for 90 days for quality improvement, abuse prevention, and to address user inquiries about prior conversations. After 90 days, chat session data is deleted. Aggregated, non-personally identifiable usage statistics (such as total message counts and topic categories) may be retained longer.
Security:
We use rate limiting, input validation, and automated abuse detection to protect the AI chat feature. Chat sessions are identified by randomly generated session identifiers, not by your account credentials. On your first message in each session, we may verify that you are a human user through an automated challenge.
Your Choices:
Use of the AI chat feature is entirely optional. You may close the chat widget at any time. All information available through the AI assistant is also available through our Knowledge Base or by contacting team@racery.com. If you do not want your race activity data used for personalized chat responses, you may use the chat feature on non-race pages, where no activity data is accessed.
Use of Data
Pressflex LLC uses the collected data for the legitimate business purposes relating to the Service including:
- To provide, maintain and improve our Service
- To respond to your requests and questions
- To notify you about changes to our Service
- To allow you to participate in interactive features of our Service when you choose to do so
- To provide customer support
- To gather analysis or valuable information so that we can improve our Service
- To monitor the usage of our Service
- To detect, prevent and address technical issues
We may also use your information to communicate and provide additional information that may be of interest to you about Racery and Race Sponsors; and send you reminders, updates, marketing messages (including on behalf of Race Sponsors). We may use information regarding how you use the Service, including the type of races in which you participate, to deliver advertisements and content targeted to you (with your consent where required by law).
We may aggregate, use and analyze non-personally identifying user information, including survey data, race histories and demographic information, to understand our users and improve the Service or create new products and services. We may also create and publish or sell market research papers and data based on such aggregate non-personally identifiable information. We also may use information collected as described in this Privacy Statement with your consent or as otherwise required or permitted by law.
Disclosure of Data
In general, we will not sell, share, disclose or rent your Personal Data in ways other than disclosed in this statement.
Information you post to the Services, such as photographs, Race updates and comments, will be publicly available to visitors, other users of the Service participating in the Races or on your Teams. If you do not wish for other users to have access to or view such information, you should not post it through the Service. Information in your Bio is available to the public and all visitors to your race or the Service.
We may disclose your Personal Data: (i) to our service providers that work with us to provide the Service; (ii) in order to comply with legal orders, and government and law enforcement requests, and other applicable laws, rules or regulations; (iii) enforce our Terms; (iv) detect prevent or address fraud, security or technical issues; and (v) as we deem reasonable or necessary to protect against or mitigate harm to the rights, property or safety of Racery, other users of the Service or third parties.
Sharing Information with Race Sponsors
When you register for or participate in a Race, we share your personal information with the Race Sponsor of that Race.
What We Share:
- Your name and email address
- Your race participation data and performance
- Information from your Bio and race updates
- Any other information you provide related to that specific Race
Why We Share:
Race Sponsors use this information to communicate with participants, send race-related updates, and may send promotional offers related to future races or their organization's activities.
Your Rights:
- You consent to this sharing when you register for a Race
- We are not responsible for how Race Sponsors use your information after it is shared
- We recommend reviewing the Race Sponsor's privacy policy before registering for their Race
- You may opt out of receiving promotional emails from Race Sponsors by following the unsubscribe instructions in their emails
- Under California law (CPRA), this may constitute "sharing" of personal information. See the "California Residents" section below for your opt-out rights.
If you do not want your information shared with a Race Sponsor, do not register for or participate in their Race.
Sharing Personal Information with Third-Party Services
We share personal information with the following categories of third parties:
Advertising and Analytics Partners:
We use Google Analytics, Google Ads, Facebook/Meta, and The Trade Desk, which receive and process your personal information including IP address, device identifiers, browsing behavior on our Service, and demographics and interests data. This sharing enables us to analyze Service usage, deliver targeted advertisements, and measure advertising effectiveness. Under California law (CPRA), this constitutes "sharing" of personal information. You can opt out of this sharing by rejecting advertising cookies via our cookie consent banner or the "Cookie Settings" link in our footer. See the "Tracking & Cookies" section above for individual service opt-out links.
Payment Processors:
We use third-party payment processors (such as Stripe) to process payments. We do not store your complete credit card information. For more information, see www.stripe.com/privacy
Service Providers:
We share personal information with service providers who help us operate the Service, including hosting providers, email service providers, and analytics providers. These providers are contractually required to protect your information and use it only for the purposes we specify.
AI Service Provider:
We use Anthropic, PBC as our AI service provider to power the chat assistant feature on our Service. When you use the AI chat feature, your messages and relevant context are transmitted to Anthropic for processing. Anthropic is contractually required to process this data solely to provide responses to your queries and does not use it to train AI models. See the "AI-Powered Features" section above for details on the data involved.
Email Communication: Users of the Service may receive email communications, promotions and offers from us and Race Sponsors, which may include races in which you are participating and those you are not. By registering for the Service or participating in a Race, you agree to receive these email communications. If you wish to end your participation in a Race or remove your email address from our communications list, please contact us. If you wish to opt out of receiving offers directly from Race Sponsors, you can follow the opt-out instructions in the emails that they send you.
Social Media Sites: We may have pages or other presence on various social networking sites or services, such as Facebook, Instagram and the like ("Social Networks"). Information you post on or through such Social Networks will be subject to the policies of the Social Network. If you have linked your Racery account with any of your Social Networks, or if you registered with Racery through your Social Network, we may receive, access and use personal information on your Social Network in connection with the Service as permitted under your permission settings.
Links To Third Party Sites: Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Corporate Events: If Racery is sold or acquired by a third party, your Personal Data may be included in the assets sold or transferred to the acquirer. In the event of a bankruptcy, insolvency or similar event, we may not be able to control how your Personal Data is treated, transferred or used.
Security Of Data: The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
"Do Not Track" Signals
Some web browsers have a "Do Not Track" (DNT) feature that signals to websites that you do not want your online activities tracked. We do not currently respond to DNT signals because there is no industry-standard definition of how to interpret them. However, you can control tracking on our Service by using our cookie consent banner or the "Cookie Settings" link in our footer to reject non-essential cookies.
You can also set your browser to refuse cookies or alert you when cookies are being sent. Instructions vary by browser:

Retention of Data
We retain your personal information only as long as necessary for the purposes described in this Privacy Statement or as required by law.
Account and Profile Information:
- Email address and name: Deleted 24 months after your last participation in a virtual race
- If you actively participate in races, your information is retained while your account remains active
- Race history, Bio information, and updates: Retained while your account is active, then deleted 24 months after last participation
Usage Data and Analytics:
- Website analytics data: Retained for up to 26 months
- IP addresses and device information: Retained for security and fraud prevention purposes for up to 12 months
Marketing and Communications:
- Email communication records: Retained for 24 months or until you unsubscribe
- If you unsubscribe, we retain your email address on a suppression list to honor your opt-out preference
AI Chat Data:
- Chat session data (messages, responses, metadata, feedback): Retained for 90 days
- Aggregated usage statistics (non-personally identifiable): May be retained indefinitely
Financial Records:
- Payment transaction records: Retained for 7 years to comply with tax and accounting requirements
- We do not store complete credit card numbers
Legal Compliance:
We may retain information longer when required by law, to resolve disputes, enforce our agreements, or protect our legal rights.
When we delete your information, we use reasonable efforts to permanently destroy it. Some backup copies may persist in our systems for a limited time but are not accessible for regular use.
To request deletion of your personal information before the automatic deletion period, please contact us at privacy@pressflex.com.
Location of Servers: We use third party service providers to store and process Personal Data in the United States and other countries. By providing your information and using the Website, you explicitly consent to the transfer, processing, and storage of your information in the United States. If you do not wish for us to transfer your personal information to the United States, please contact us using the information in the "Contact" section below.
Individual Rights
EU/EEA Citizens
The EU General Data Protection Regulation (GDPR) grants individuals who are in the European Union and European Economic Area (EU/EEA) certain rights, with some limitations. We will facilitate the exercise of data subject rights related to:
- Information access;
- Objection to processing;
- Objection to automated decision-making and profiling;
- Restriction of processing;
- Data portability;
- Data rectification; and
- Data Erasure
Automated Processing: Our AI chat feature on race pages may use your race activity data to classify your participation status for the purpose of providing personalized motivational messages. This processing is based on our legitimate interest in providing a useful service experience and does not produce legal effects or similarly significant effects concerning you. You may object to this processing by contacting us at privacy@pressflex.com.
California Residents (CPRA)
The California Privacy Rights Act (CPRA) provides California consumers with specific rights regarding their personal information:
Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you in the last 12 months, including the sources of collection, business purposes, and categories of third parties with whom we share your information.
Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions required by law.
Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale or sharing of your personal information. We share personal information with advertising partners (Google, Facebook/Meta, The Trade Desk) through advertising cookies, and with Race Sponsors when you participate in a Race. Under CPRA, this may constitute "sharing" of personal information. When you use our AI chat feature, your messages are processed by our AI service provider (Anthropic) to generate responses; this processing is performed on our behalf as a service provider and does not constitute a "sale" or "sharing" of personal information under CPRA.
Right to Limit Use of Sensitive Personal Information: If we collect or use sensitive personal information beyond what is necessary to provide our services, you have the right to limit such use.
Non-Discrimination: We will not discriminate against you for exercising any of your CPRA rights.
How to Exercise These Rights:
To exercise these rights, please contact us at privacy@pressflex.com or use the contact information below. You may designate an authorized agent to make requests on your behalf by providing written authorization. We will verify your identity before processing requests. We will respond to verifiable requests within 45 days. If we require additional time, we will notify you of the extension and the reason.
Do Not Sell or Share My Personal Information:
To opt out of the sharing of your personal information with advertising partners, you can:
- Reject advertising cookies via our cookie consent banner or the "Cookie Settings" link in our website footer
- Email us at privacy@pressflex.com with the subject "Do Not Sell or Share My Personal Information"
Global Privacy Control (GPC): We are working to implement recognition of Global Privacy Control signals. Until this feature is deployed, you may use the methods above to opt out of the sharing of your personal information.
Exercising Your Rights
If you would like to exercise any of the rights described above under the EU General Data Protection Regulation (GDPR) or the California Privacy Rights Act (CPRA), please submit a written request to: privacy@pressflex.com or contact us using the information provided in the "Contact" section below. Our privacy team will examine your request and respond to you as quickly as possible.
Children's Privacy: The Service is not designed or intended for children under 13 years old. We will delete information associated with any account if we have actual knowledge that the account is associated with a user who is not at least thirteen years old.
